Mark Eschbach am a single developer building out services for free or a small fee. You are using a hobby system and not a commercial or industrial system. As a result data might be lost, things get damaged, etc. Look, Mark will try his best to make it awesome but shit happens and everything in the world eventually fails. You are along for the ride and hopefully things end well.
Overall you agree to indemnify Mark Eschbach and anyone helping him with this project from any liability, fitness of purpose, or really anything. It is a hobby project written in someone's free time. You must not interfere with the operations of Mark Eschbach's systems, affiliated systems such as ISPs and hosting providers.
Mark Eschbach is in Davis, California. If there are any problems you agree Davis, California will be the venue for such issues to be heard, including all applicable interpretations, etc. If you can not agree to such terms then you must not use the software, regardless of reason such as un-waivable rights. For example, those requiring GDPR requirements or California's digital rights for applicable to businesses.
Defects may occasionally discovered while utilizing these systems. Regardless of area the defect occurs, such as security, you agree to immediately contact Mark Eschbach to disclose immediately.
If you are or have ever been in litigation against Mark Eschbach for any reason you understand you are not allowed to use these systems. Futhermore if your employer is involved in litigation against Mark Eschbach you understand you are not authorized to access these systems.
